Website Terms of Use

These terms apply to your use of www.studentcastle.co.uk and any Student Castle webpages, online tools or website functions that link to them (the “Website”). Please read them before using the Website.

1. About us

The Website is operated by Student Castle Property Management Services Limited (“Student Castle”, “SCPMS”, “we”, “us” or “our”), a company incorporated in England and Wales under company number 07119911. Our registered office is Kintyre House, 70 High Street, Fareham, Hampshire, England, PO16 7BB. Our head office and correspondence address is 4th Floor, WestWorks, White City Place, 195 Wood Lane, London W12 7FQ.

We manage student accommodation for property-owning entities within our group and for other relevant landlords. The legal entity that provides your accommodation will be identified in the booking process and/or your tenancy, licence or other accommodation agreement.

2. These terms and your accommodation contract

·       These Website Terms govern use of the Website. They do not replace the separate terms that apply to a room reservation, tenancy, licence, guarantor arrangement, resident portal, payment plan, promotion, competition or other service.

·       If you make a booking, the accommodation agreement and any booking terms presented to you during that process will govern the accommodation itself. If there is a conflict about the accommodation, those specific terms will take priority over these Website Terms.

·       Promotions, incentives, price-match offers, referral schemes and competitions may have their own terms. You should read those terms before participating.

·       Nothing in these Website Terms affects any rights you have under applicable consumer law.

3. Accepting these terms

By using the Website, you agree to comply with these Website Terms. If you do not agree, you should not use the Website.

The Website may be browsed by prospective students who are under 18. However, some transactions or accommodation arrangements may only be entered into by an adult, or may require a parent, guardian or guarantor. The relevant booking or accommodation terms will explain any age requirements.

If you use the Website on behalf of a company or another person, you confirm that you have authority to act for them where such authority is required.

4. Website availability and changes

·       We may update, change, suspend or withdraw all or part of the Website for operational, security, maintenance or business reasons.

·       We do not guarantee that the Website, any particular feature, or any content will always be available or uninterrupted.

·       Where reasonably practicable, we will try to minimise disruption to important customer-facing services.

5. Property information, availability, prices and bookings

·       We take reasonable care to keep property descriptions, images, facilities, distances, availability, prices and other Website information accurate and up to date. However, content may change and errors can occur.

·       Images, floorplans, maps and virtual tours are illustrative unless we expressly state otherwise. Individual rooms, views, layouts, furnishings and finishes can vary.

·       Availability and pricing can change quickly. A room is not secured merely because it appears available on the Website, is placed in a booking journey, or is discussed with us. A booking is only confirmed in accordance with the applicable booking process and accommodation terms.

·       If we identify an obvious pricing, availability or content error before a binding accommodation contract is formed, we may correct it. If a binding contract has already been formed, we will deal with any error in accordance with that contract and applicable law.

·       Any travel times or distances are approximate and may vary depending on route, transport conditions and the source used.

6. Accounts, forms and online services

·       You are responsible for providing accurate and current information when completing forms, enquiries, booking journeys or account registrations.

·       You must keep login credentials confidential and should tell us promptly if you believe an account has been compromised.

·       Some functions, including booking, payments, resident portals, virtual tours, live chat or appointment tools, may be provided through third-party systems. Additional terms or privacy information may apply to those systems.

·       We may suspend access to an account or online function where reasonably necessary to protect users, security, the Website or our legal rights.

7. Acceptable use

You may use the Website for lawful, personal and non-commercial purposes connected with finding, booking or managing Student Castle accommodation, or otherwise interacting with us. You must not:

·       use the Website in breach of any applicable law or regulation;

·       attempt to gain unauthorised access to the Website, its servers, databases, accounts or connected systems;

·       introduce viruses, malware, harmful code or other material intended to disrupt or damage the Website;

·       carry out denial-of-service attacks, interfere with security controls, or deliberately overload the Website;

·       use automated scraping, harvesting, crawling or extraction tools in a way that materially burdens the Website, circumvents technical restrictions, or is used to build a competing commercial service without our permission;

·       impersonate another person or submit information that you know is false, misleading or unlawful; or

·       use Website content for commercial exploitation except with our written permission or where permitted by law.

8. Intellectual property

The Website and its content, including text, design, branding, photographs, graphics, video, software and databases, are owned by or licensed to Student Castle and are protected by intellectual property laws.

You may view, download or print reasonable extracts for your personal, non-commercial use. You must not reproduce, modify, republish, distribute, sell or commercially exploit Website content without our prior written permission, except where the law permits it.

Student Castle names, logos and other brand assets may not be used in a way that suggests endorsement, partnership or affiliation without our permission.

9. Linking to the Website

You may link to publicly available pages on the Website in a fair and lawful way, provided you do not damage our reputation, suggest an association or endorsement that does not exist, or frame the Website in a misleading manner. We may ask you to remove a link where there is a legitimate reason to do so.

10. Third-party websites and services

The Website may contain links to or integrations with third-party websites, platforms or services. These are provided for convenience. Unless we expressly say otherwise, we do not control and are not responsible for their content, availability, security or privacy practices. You should review the terms and privacy information that apply to any third-party service you choose to use.

11. Privacy and cookies

Our Privacy Policy explains how we handle personal data. Our Cookie Policy explains how we use cookies and similar technologies and how you can manage your choices. Both policies form part of the information you should read when using the Website.

12. Information on the Website

Website content is provided for general information about Student Castle and its accommodation. Although we take reasonable care when preparing it, you should not rely on general Website content as professional, financial, immigration, legal, medical or other specialist advice.

Where a specific representation is incorporated into a binding accommodation contract, your rights in relation to that representation are governed by the contract and applicable law.

13. Security and viruses

We take reasonable steps to operate the Website securely, but no website can be guaranteed to be completely secure or free from defects or malicious code. You are responsible for using appropriate security and antivirus measures on your own devices. If digital content we supply causes damage because we failed to use reasonable care and skill, your statutory rights are not affected.

14. Our liability

Nothing in these Website Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot be excluded under consumer law.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Website Terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, or for business losses arising from your use of the Website for commercial purposes.

If you use the Website for business purposes, our liability will be subject to any separate written agreement between us and, to the fullest extent permitted by law, we exclude implied warranties and liability for indirect or consequential loss.

15. Suspension or termination of access

We may restrict or suspend access to the Website or an account if you materially breach these Website Terms, misuse the Website, create a security risk, or where suspension is reasonably required for legal, operational or security reasons. Where appropriate, we will provide reasonable notice or an explanation.

16. Changes to these Website Terms

We may update these Website Terms from time to time, for example to reflect changes to the Website, our business or the law. The latest version will be published on this page and will show the date it was last updated. Changes will apply from publication unless a later date is stated. Any change to an existing accommodation contract will be governed by that contract, not merely by an update to these Website Terms.

17. General

·       If any provision of these Website Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

·       A delay or failure by us to enforce a provision does not waive our right to enforce it later.

·       Unless the law requires otherwise, no person other than you and Student Castle has a right to enforce these Website Terms under the Contracts (Rights of Third Parties) Act 1999.

18. Governing law and courts

These Website Terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also be entitled to bring proceedings in your local courts. Nothing in this section limits any mandatory rights you have under the law of the country in which you live.
